All deliveries of Spreadshirt to the customer are made on the basis of the following general business and delivery conditions. These terms and conditions form the basis of all offers and agreements between Spreadshirt and the customer and apply as accepted for the entire duration of the business relationship. Buyer's terms that violate or deviate from these terms are binding only if Spreadshirt has agreed to these in writing.
§ 2 Responsibility for online offers
(1) On Spreadshirt's platform, two types of shops are available. Firstly, a shop designed and operated by Spreadshirt itself ("Spreadshirt-shops"), and secondly, shops designed and operated by independent shop-owners ("partner shops"). (2) Spreadshirt is responsible for the articles and designs offered in a "Spreadshirt-shop" and for the decoration of the entire shop.
(3) For the articles and motifs offered in a "Partner shop" and for the decoration of the shop as well as for the advertising of the offered articles, the shop owner in question is solely responsible. Spreadshirt does not expressly take over the content of the shop owner unless it complies with the terms of these general terms and conditions and / or the general terms and conditions of the shop owner . § 3 Conclusion of the agreement

(3) In the context of §2 (3), it is not possible for Spreadshirt as a platform provider to check in advance print designs designed by customers or shop owners for any legal violations. (4) The conclusion of the agreement is subject to timely and complete self-delivery. This disclaimer does not apply in the event of short-term delivery disruptions or if Spreadshirt is required to handle a non-delivery, in particular because Spreadshirt neglects to complete a congruent coverage business in a timely manner. § 4 Delivery / shipment

§ 5 Prices

§ 6 Payment
(1) Payment follows at the customer's choice via bank transfer (SEPA basic payment agreement), credit card, transfer or other payment method. Spreadshirt reserves the right to restrict the choice of payment methods that the customer can choose from, depending on the value of the order, the area it is to be sent to or other objective criteria. For payment by bank transfer (SEPA basic payment agreement), Spreadshirt sends the pre-notification after the order has been placed in accordance with the rules on confirmation of order (see § 3 section 2). The debit follows for the account-holding banking institutions in Germany, Austria and Spain no earlier than 1 day after notification, at account-holding banking institutions in other countries no earlier than 5 days after sent notification.
(3) Spreadshirt is entitled to use third party services during the settlement of the payment:

§ 7 Retention of title
(1) The item is the property of Spreadshirt until the settlement of the claims due to Spreadshirt. If the customer is a trader in accordance with German commercial law, Spreadshirt reserves the ownership of all delivered items to everyone from the time the business's payments are received.
(2) The customer is obliged to treat the goods carefully until the ownership is transferred to the customer.
§ 8 Right of complaint
(1) Indications, drawings, illustrations, technical data, descriptions of weights, dimensions and services given in brochures, catalogs, circulars, advertisements or price lists are of a purely informative nature. Spreadshirt is not responsible for the accuracy of this information. With regard to the nature and scope of the delivery, only the information in the order confirmation is decisive.
(2) If there is a defective warranty, the customer is, within the framework of the legal provisions, entitled to demand compensation, to terminate the agreement or to reduce the purchase price.
(3) In case of returns due to defects, Spreadshirt also pays the postage costs.
4) The data communication via the Internet, according to the current technical level, cannot be guaranteed to be error-free and / or available at all times. Spreadshirt is therefore not responsible for the fact that the online offer is always and continuously available.
(5) The customer's rights under the guarantee presuppose that he / she, if the customer is a trader, has fulfilled his / her duty to investigate and make a complaint in accordance with section 377 of the German Trade Act.
(6) The limitation period for guarantee claims for the delivered goods is two years from the receipt of the goods. If the customer is a trader, the limitation period is one year.
§ 9 Limitation of liability
(1) Spreadshirt's liability is otherwise governed by the law, unless otherwise provided in these general terms and conditions of business and delivery. Spreadshirt has a legal liability not to sue only on condition of damages and gross negligence. In addition, Spreadshirt is liable indefinitely by simple negligence for damages resulting from damage to life, body or health. Exceptions to the right of withdrawal

§ 12 Technical and design deviations

§ 13 Data protection
Spreadshirt processes the customer's personal data for a specific purpose and in accordance with the legal requirements. The personal data provided when ordering goods (such as name, e-mail address, address, payment data) is used by Spreadshirt to fulfill and terminate the agreement. Spreadshirt treats this data confidentially and does not pass it on to third parties who do not take part in the ordering, delivery and payment process. The customer has the right to request, upon request, free of charge information about personal data that Spreadshirt has stored about the customer. In addition, the customer has the right to have erroneous data corrected, blocking and deletion of his personally related data, as long as there is no legal storage obligation in the way of this.
§ 14 Venue - place of performance - choice of law
(1) Fulfillment point for all deliveries is Spreadshirt's headquarters in Leipzig.
(2) If the customer is a trader under German commercial law, a legal person governed by public law or is involved in special property law, Leipzig is the place of jurisdiction. In this case, Spreadshirt is also entitled, at Spreadshirt's choice, to sue the customer in court at the customer's residence.
